This Privacy Policy describes how I collect, hold, use and disclose your personal information, and how I maintain the quality and security of your personal information.
What is personal information?
“Personal information” means any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies you either directly (e.g. your name) or indirectly.
What personal information do I collect?
The personal information I collect about you depends on how we interact and what you choose to share with me in the course of our professional relationship. The personal information I collect about you may include:
- Name;
- Mailing or street address;
- Email address;
- Phone number.
This information is collected because it allows me to:
- Identify you for invoicing, tax and other legal purposes;
- Contact you throughout your design project; and
- Deliver your design files and/or printed branding collateral.
I do not take or store any information that is not relevant to our project and delivery of your files, such as your date of birth. You have the right to refuse to disclose personal information that is not required for me to be able to complete work for you.
You also have the right to refuse to disclose necessary personal information, however I may not be able to provide you with my services in such cases. This is because without that key personal information I will not be able to fulfil my legal obligations as a taxpaying business owner.
How do I collect your personal information?
I collect your personal information directly from you when you:
- Submit an enquiry or form through my website;
- Interact with me over the phone;
- Interact with me in person;
- Interact with me online;
- Participate in surveys or questionnaires;
- Subscribe to my mailing list;
- Apply for a position with us as an employee, contractor, or intern.
Collecting personal information from third parties
I may also collect limited personal information such as age range, gender, and approximate location from third parties or through publicly available sources, for example from Google.
I collect this limited personal information from these third parties so that I can get a picture of the demographics who are interested in my services and target my marketing accordingly.
How do I use your personal information?
I may use your personal information for many purposes in connection with our functions and activities, including the following purposes:
- Providing you with information or services that you request from us;
- Delivering to you a more personalised experience and service offering;
- Improving the quality of the services I offer;
- Internal administrative purposes;
- Marketing and research purposes.
Disclosure of personal information to third parties
I may disclose your personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect me to disclose your information.
For example, we may disclose your personal information to:
- Third party service providers (for example, IT providers, printers);
- Marketing providers;
- Our professional services advisors.
Transfer of personal information overseas
Some of the third-party service providers I disclose personal information to may be based in or have servers located outside of Australia, including in the USA. Where I disclose your personal information to third parties overseas, I will take reasonable steps to ensure that data security and appropriate privacy practices are maintained.
I will only disclose to overseas third parties if:
- You have given me your consent to disclose personal information to that third party; or
- I reasonably believe that:
- The overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the APPs; and
- The law or binding scheme can be enforced; or
- The disclosure is required or authorised by an Australian law or court / tribunal order.
How do I protect your personal information?
I will take reasonable steps to ensure that the personal information that I hold about you is kept confidential and secure, including by:
- Using secure locations to conduct my work, including my home address and workspaces that require a security pass to enter.
- Deleting personal records including copies of invoices after the compulsory 5-year recordkeeping period prescribed by the Australian Government.
- Restricting access to your personal information to only myself and those who need to use it to provide your services, such as those in the aforementioned section “Disclosure of personal information to third parties”.
- Having technological measures in place (for example, strong passwords, anti-virus software, firewalls) to prevent hacking of my devices and sharing of personal information.
Online activity (Cookies)
My website uses cookies. A cookie is a small file of letters and numbers the website puts on your device if you allow it. These cookies recognise when your device has visited my website(s) before, so I can distinguish you from other users of the website. This improves your experience and my website(s) because it allows you to save actions from a previous session and allows me to recognise when potential clients visit my site multiple times. An example of cookie use is when you return to an online store and find that it’s remembered what you had in your cart from a few days ago.
If you do not wish to use cookies, you can amend the settings on your internet browser so it will not automatically download cookies. However, if you remove or block cookies on your computer, please be aware that your browsing experience and my website’s functionality may be affected.
Website analytics
My website uses Google Analytics to help me better understand visitor traffic, so I can improve my services and advertise to clients who are looking for my work. Although this data is mostly anonymous, it is possible that under certain circumstances, I may connect it to you.
Direct marketing
I may send you direct marketing communications and information about my services, opportunities, or events that I consider may be of interest to you if you have requested or consented to receive such communications. These communications may be sent in various forms, including mail, SMS, fax and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth).
You consent to me sending you those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, I will endeavour to use that method whenever practical to do so. You may opt-out of receiving marketing communications from me at any time by following the instructions to “unsubscribe” or contacting me using the details set out in the “How to contact me” section below.
In addition, I may also use your personal information or disclose your personal information to third parties for the purposes of advertising, including online behavioural advertising, website personalisation, and to provide targeted or retargeted advertising content to you (including through third party websites).
Retention of personal information
I will not keep your personal information for longer than I need to. In most cases, this means that I will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations.
How to access and correct your personal information
I will endeavour to keep your personal information accurate, complete and up to date. If you wish to make a request to access and / or correct the personal information I hold about you, you should make a request by contacting me and I will usually respond within 3 business days.
If you request to access or change your personal information held with me, I will report to you by email or preferred contact method the data I have about you and you can then choose to make corrections based on your new information. Moving forward, the new information will then be reflected in service materials that are addressed to you (including invoices and contracts).
Links to third party sites
My website(s) may contain links to websites operated by third parties. If you access a third party website through our website(s), personal information may be collected by that third party website. I make no representations or warranties in relation to the privacy practices of any third party provider or website and I am not responsible for the privacy policies or the content of any third party provider or website. Third party providers / websites are responsible for informing you about their own privacy practices and I encourage you to read their privacy policies.
